I-CARES members may use the I-CARES website in seeking employment and other services and Corporate Partners seeking employees may use this website subject to Terms and Conditions set below. Non-acceptance of the Terms and Conditions prevents anyone from using this site. Non-compliance with them will terminate access to this website. I-CARES will occasionally revise these Terms and Conditions and inform the users of said changes.

1. Acceptable Web Site Uses

a. I-CARES members

I-CARES members agree that they will only use the I-CARES web sites (and any other sites accessed through them) to seek employment and avail of other services as provided by membership. They may also choose to send their resumes to a Corporate Partner in reply to any job posting at the I-CARES Website.

In both cases, the I-CARES members' resumes will also remain active on the I-CARES web sites and stored in the I-CARES website Database at the Jobseeker's own risk. The I-CARES web site also reserves the right to edit any I-CARES member's resume as it sees fit.

I-CARES members accept that personal data given to Corporate Partners or other users are given entirely at their own risk. They also agree not to hold I-CARES the website responsible or liable in any way if any Corporate Partner, whether in Philippines or elsewhere, use their personal data for any other use other than for obtaining potential employees.

b. Corporate Partners

Corporate Partners will be entitled to use the I-CARES web sites to post for vacant job openings and access the I-CARES Members Database. However, they agree that all information obtained will only be used for the purpose of obtaining potential employees.

All contents and materials contained in their job postings will be the sole responsibility of the Corporate Partners. However, they can be edited or revised by the I-CARES web site any time it sees fit.

2. Prohibited Uses – I-CARES Members and Corporate Partners

I-CARES Members and Corporate Partners agree to the following terms:

  1. I-CARES Members shall not post any non-resume information. Neither can they post resume information that is incomplete, false, and inaccurate.
  2. Any form of communications and activity soliciting business for any other reason other than employment is forbidden. All transactions between I-CARES members and Corporate Partners should concern the possibilities and opportunities for employment.
  3. Corporate Partners and I-CARES members cannot use or obtain any personally identifiable information about other users. Nor can they print, download, duplicate, or copy in any means these data.
  4. Corporate Partners and I-CARES members cannot tamper, delete, or change any material posted by other Members and Partners.
  5. Any attempt to violate the I-CARES web sites (or any other sites accessed through the Company's web sites) or access information not intended for use will be regarded as a violation of system and network security which may result in criminal or civil liability. These attempts include probes, scanning, vulnerability tests, security or authentication measure breaches without proper authorization, interference with any service to a Corporate Partner or member, hosting, networking, the sending of unsolicited email which includes promotions and/or advertising of products and services.
  6. All users will not use the I-CARES web sites in order to transmit, distribute or store material in violation of any applicable law or regulation, or in any manner that will infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.

3. Copyright, Trademarks etc.

The graphics, images, editorial content and HTML on all the I-CARES web sites are the intellectual property of I-CARES and are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of the web site. The I-CARES web site reserves all rights and strictly forbids this aforementioned activity.

4. Responsibility

The I-CARES web site does not assume any responsibility whatsoever for any material inputted by any user or others. The Corporate Partners and I-CARES members acknowledge and agree that they are solely responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them. Neither is the I-CARES web site responsible for the content of any other web sites linked to the Company's web sites. The I-CARES web site does not automatically guarantee that any resume, advertisement or web page will be viewed by any specific number of users.

The I-CARES web site is not in anyway to be considered an agent with respect to any I-CARES member or Corporate Partner's using its sites. Nor can it be held responsible in any way for any employment/recruitment decision made, for any reason, by any I-CARES member or Corporate Partner.

The I-CARES web site does not guarantee the following: a) the error-free operation of its websites at all times; b) freedom from viruses and other harmful mechanisms of its sites and servers. It cannot be held responsible for any costs that a Corporate Partner or I-CARES member may spend in servicing or replacing equipment or data. To the fullest extent permitted by law, the I-CARES website disclaims all warranties, including without prejudice to the foregoing, any in respect of merchantability, non-infringement of third party rights, fitness for particular purpose. It also disclaims all warranties about the accuracy, reliability, completeness, or timeliness of the contents, services, software, text, graphics, and links of the I-CARES web site.

5. Own Risk

CORPORATE PARTNERS AND I-CARES MEMBERS USE THE I-CARES' WEB SITES AND ANY OTHER WEB SITES ACCESSED THROUGH IT AT ENTIRELY THEIR OWN RISK. They are responsible for their own communications and the consequences of their posting. The I-CARES Website does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Users rely on materials posted by other users at their own risk.

The I-CARES web site reserves the right to expel any user and prevent their further access to the Company's Web Sites at any time for breaching this Agreement or violating the law. It also reserves the right to remove any material which is abusive, illegal or disruptive.

6. Links to Other Sites

The I-CARES' Web Sites may contain links to third party web sites. These are provided for the sake of convenience and cannot be regarded as an I-CARES website endorsement on such third-party web sites. Users may access any linked third party web sites entirely at their own risk. The I-CARES web site is not responsible for the content of any third party web sites linked to its web sites and does not make any representations or warranties regarding the contents or accuracy of materials in such third-party web sites.

Further, any material or details posted in the I-CARES web sites by any user may be viewed by users of other web sites linked to the Company's web sites. The I-CARES web site will not be responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Company's web sites.

7. Indemnity

All users agree to indemnify, and withhold from any claim the I-CARES web site, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Company's Web Sites or their breach of the terms of this Agreement. The I-CARES web site shall provide prompt notice of any such claim, suit or proceeding to the relevant user.

8. Disclaimer

THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS SHALL NOT BE HELD LIABLE IN ANY EVENT FOR ANY LOSSES OR DAMAGES SUFFERED BY ANY USER, I-CARES MEMBER AND/OR CORPORATE PARTNER, WHATSOEVER ARISING OR RESULTING FROM THEIR USE OR INABILITY TO USE THE COMPANY'S WEB SITES AND ITS CONTENTS.

9. Governing Law and Jurisdiction

This Agreement and any dispute or matter arising from or incidental to the use of the company's Web Sites shall be governed by the laws of Philippines and the users, I-CARES member and/or Corporate Partner, and the I-CARES web site submit to the exclusive jurisdiction of the Makati courts of Philippines.
